Estate Planning:

Every estate plan needs a core set of documents that will protect you while you are alive and plan for your passing.

  1. Will or Trust: Provides for distribution after death.
  2. Power of Attorney: Appoints an agent to make financial decisions for you when you cannot speak for yourself.
  3. Advance Health Care Directive: Appoints an agent to make health care decisions for you when you cannot speak for yourself.

Guardianship and Conservatorship:

Guardianship is necessary when your loved one is unable to understand and make decisions about their finances or health. If someone does not have a validly executed power of attorney, then the court must be involved to ensure that a vulnerable individual is protected.

Anyone who wishes to be a court appointed guardian or conservator must make an application to the court. The incapacitated individual must have separate counsel.

Probate:

Probate is the process of administering a deceased loved one’s estate. Estate refers to all the property owned by a person.

Most people hold different types of property throughout their life including real property, tangible personal property, and various bank accounts. When someone dies, that property gets transferred to their family. Probate is the process of distributing property to the right people.

Probate is required when someone owns real property or has a net worth of $100,000 or more. The court will appoint a personal representative who has power to deal with creditors, inventory property, and distribute property to heirs.

There are certain deadlines and responsibilities to follow when probating an estate. I handle all aspects of the process and allow you to grieve.

Medicaid:

Medicaid is a joint federal and state program that pays for medical costs for individuals who qualify. There are very complex rules that differ from state to state. It is important to talk to a professional so you understand whether you can qualify.
